LEGENDARY ESCORT®

General Terms and Conditions of Legendary Escort

1. Scope of Application

These General Terms and Conditions apply to all contracts and business relationships between Legendary Escort, hereinafter referred to as “the Agency,” and its clients in connection with the use of the website, the processing of inquiries, and the arrangement and organisation of companionship services.

Any terms and conditions of the client that deviate from or conflict with these General Terms and Conditions shall apply only if the Agency has expressly agreed to them in text form.

2. Provider and Agency

Legendary Escort is the business or brand name of the company identified in the website’s legal notice.

The complete legal information, including the company name, registered address, commercial register number, and VAT identification number, can be found in the website’s legal notice.

The Agency can be contacted using the following details:

Email: booking@legendary-agency.com
Telephone: +49 170 9604004

3. Scope of Services

Depending on the individual agreement, the Agency may provide the following services in particular:

  • Processing and coordinating client inquiries;
  • Arranging contact with independently operating models;
  • Coordinating availability, location, period, and duration;
  • Providing organisational support with travel, hotel, and transfer arrangements;
  • Providing information regarding the agreed framework conditions;
  • Coordinating communication between the client and the model.

The specific scope of services shall be determined by the respective individual agreement or booking confirmation.

There shall be no entitlement to the arrangement of a specific model, period, location, or duration unless this has been expressly confirmed in text form.

4. Brokerage Relationship

The Agency generally acts as an intermediary and organisational contact.

The respective model arranged by the Agency acts independently and on their own responsibility. In particular, the model independently decides on:

  • Accepting or rejecting an inquiry;
  • Their own availability;
  • Their personal boundaries and conditions;
  • Conducting or terminating a companionship arrangement.

Unless expressly agreed otherwise, the contract concerning the personal companionship is concluded directly between the client and the respective model.

The Agency does not become the model’s employer, employee, legal representative, or personal contractual partner as a result of the arrangement.

5. Client Requirements

Inquiries and bookings may be made only by persons who have reached the age of majority.

The client undertakes to:

  • Provide truthful and complete information;
  • Not use a false identity;
  • Not make a booking for another person without that person’s knowledge and consent;
  • Comply with the agreed payment and booking conditions;
  • Treat the model respectfully and in accordance with applicable laws;
  • Respect the model’s personal boundaries at all times.

Before confirming a booking, the Agency may request appropriate proof of identity and legal age.

6. Inquiry and Conclusion of Contract

An inquiry submitted by the client does not constitute a binding booking.

A contract shall only be concluded once:

  • Availability has been confirmed;
  • The essential booking conditions, particularly the location, period, duration, and remuneration, have been agreed;
  • The Agency has confirmed the booking in text form;
  • The agreed deposit or advance payment has been received within the applicable deadline.

An automatic confirmation that an email or contact-form submission has been received does not constitute a booking confirmation.

7. Booking Confirmation

The booking confirmation may include the following information in particular:

  • The name or designation of the booked model;
  • The date or period of the companionship;
  • The location and, where applicable, accommodation;
  • The agreed duration;
  • The remuneration and other costs;
  • The amount and due date of the deposit;
  • The payment method;
  • Conditions regarding amendments and cancellations;
  • Any travel, hotel, and transfer costs.

The individual booking confirmation shall take precedence over these General Terms and Conditions insofar as it expressly contains provisions that differ from them.

8. Prices and Remuneration

The prices applicable to a specific booking shall be communicated to the client in text form before the booking becomes binding.

The total remuneration may consist in particular of:

  • The model’s fee;
  • An agency or organisational fee;
  • Travel and transport costs;
  • Hotel and accommodation costs;
  • Costs for special organisational services;
  • Statutory VAT, where applicable.

Any additional costs shall be communicated to the client before they are incurred, provided that they are already known or foreseeable at the time of booking.

9. Payment Terms

Payment shall be made in accordance with the individual booking agreement.

Unless otherwise agreed, a booking shall only be bindingly reserved once the agreed deposit has been received.

The Agency may require full advance payment, particularly for short-notice bookings, travel companionship, or bookings involving an increased organisational effort.

In the event of late payment, the Agency shall be entitled to suspend or cancel the booking until full payment has been received.

Statutory claims arising from late payment shall remain unaffected.

10. Deposits

A deposit serves to reserve the agreed period and shall be credited against the total remuneration if the booking is carried out.

The refund of a deposit shall be governed by the individual booking confirmation and the applicable statutory provisions.

Costs that have already arisen and are non-refundable may be taken into account. These may include, in particular:

  • Travel and transport costs;
  • Hotel costs;
  • Transfer costs;
  • Payment service provider fees;
  • Costs of short-notice rebookings;
  • Brokerage and organisational services already provided.

11. Changes Requested by the Client

Changes to the location, period, duration, accommodation, or other essential booking conditions require the prior consent of the Agency and, where applicable, the model.

The client shall have no entitlement to the implementation of a requested change.

Any additional costs arising from changes shall be borne by the client, provided that they have been communicated in advance and confirmed by the client.

12. Cancellation by the Client

A cancellation must be submitted in text form. It shall become effective once it has been received by the Agency.

Depending on the time and circumstances of the cancellation, the following costs may be incurred in particular:

  • Travel and transport costs already incurred;
  • Non-refundable hotel costs;
  • Rebooking costs;
  • Brokerage and organisational services already provided;
  • Reasonable cancellation costs, provided that the period cannot be allocated elsewhere.

The cancellation conditions applicable to each booking shall be communicated to the client before the booking becomes binding.

The client shall remain entitled, where legally permissible, to demonstrate that no loss or a substantially lower loss was incurred.

13. Cancellation by the Model or the Agency

The model may reject or terminate an inquiry or booking for personal, health-related, organisational, or safety-related reasons.

The Agency shall be entitled to reject, suspend, or terminate an inquiry or booking if:

  • The client has provided inaccurate information;
  • There are doubts regarding the client’s identity or legal age;
  • The agreed payment has not been received on time;
  • The client breaches these General Terms and Conditions;
  • A dangerous, harassing, threatening, or otherwise unreasonable situation exists;
  • The performance is legally or factually impossible.

Unless the cancellation is attributable to the client’s conduct, payments already made shall be refunded, less any costs already incurred and non-refundable, or credited against another booking by agreement.

14. Conduct and Personal Boundaries

Personal companionship shall take place exclusively on a voluntary basis.

The client must respect the model’s personal boundaries, decisions, and instructions at all times.

The following are prohibited in particular:

  • Violence, threats, coercion, or intimidation;
  • Unwanted physical or sexual acts;
  • Harassment or discriminatory conduct;
  • Covert image, video, or audio recordings;
  • Publication or disclosure of private information;
  • The presence of unregistered persons;
  • Bringing weapons or dangerous objects;
  • Requests to carry out unlawful acts;
  • Any form of human trafficking, exploitation, or coercion.

In the event of a breach, the model may terminate the companionship immediately. Any entitlement to continuation or a refund shall exist only in accordance with the applicable statutory provisions and the respective booking agreement.

15. Minors and Unlawful Inquiries

The arrangement of minors is prohibited.

Inquiries relating to coercion, exploitation, human trafficking, covert recordings, or other unlawful acts shall be rejected.

The Agency may document such incidents and, where legally required or permitted, forward them to the competent authorities.

16. Travel, Hotel, and Transfer Services

Additional travel, hotel, and transfer costs may arise for bookings outside the model’s usual location.

The details shall be communicated and agreed before the booking becomes binding.

The client must provide a safe and appropriate environment. The Agency may specify requirements concerning accommodation, meeting locations, or transportation.

For services provided by hotels, airlines, transport companies, event organisers, or other third-party providers, the Agency shall be liable only within the scope of applicable law and only insofar as the Agency itself is responsible for a breach of duty.

17. Discretion and Confidential Information

The parties shall treat all personal and business information received in connection with an inquiry or booking as confidential.

Without prior consent, the client must not, in particular:

  • Store or disclose the model’s personal data;
  • Publish private contact details;
  • Make images, videos, or audio recordings;
  • Use information about the booking or the model for advertising or promotional purposes.

Statutory duties to provide information, report incidents, or notify authorities shall remain unaffected.

18. Website Content

The texts, profiles, images, and other content available on the website may be used exclusively for personal information purposes.

Reproduction, editing, publication, disclosure, or commercial use is not permitted without the prior consent of the Agency or the respective rights holder.

The Agency shall be entitled to modify, supplement, temporarily make unavailable, or permanently remove content.

19. Data Protection

Personal data shall be processed exclusively in accordance with applicable data-protection legislation.

Further details regarding the collection, processing, storage, and use of personal data are set out in the website’s separate Privacy Policy.

20. Liability

The Agency shall be liable without limitation for damage caused by wilful intent or gross negligence, as well as for damage resulting from injury to life, body, or health.

In the event of a slightly negligent breach of material contractual obligations, the Agency shall be liable only for foreseeable damage that is typical for the type of contract.

In all other respects, liability shall be excluded to the extent permitted by law.

In particular, the Agency shall not be liable for:

  • The personal decisions or conduct of a model;
  • The model’s rejection or termination of a companionship arrangement;
  • The availability of a particular model;
  • The services of external providers;
  • Damage caused by the client;
  • Technical disruptions outside the Agency’s control.

The above limitations of liability shall also apply in favour of the Agency’s legal representatives, employees, and agents.

21. Complaints

Complaints should be submitted as soon as possible and in text form to the following email address:

booking@legendary-agency.com

The complaint should contain an objective description of the circumstances and, where available, the relevant booking details.

The client’s statutory rights shall remain unaffected by the Agency’s internal complaints procedure.

22. Right of Withdrawal

Consumer contracts may be subject to a statutory right of withdrawal.

Whether a right of withdrawal exists and whether a statutory exception applies depends on the specific type of contract and the time at which the service is performed.

Where a right of withdrawal exists, the consumer shall receive separate instructions on withdrawal, including the information required by law.

If performance begins before the withdrawal period has expired at the consumer’s express request, the statutory consequences concerning compensation for the value of services provided or the expiry of the right of withdrawal may apply.

23. Applicable Law

The contractual relationship shall be governed by Dutch law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

In relation to consumers, the mandatory consumer-protection provisions of the country in which the consumer has their habitual residence shall also apply, insofar as they are applicable.

24. Place of Jurisdiction

For merchants, legal entities under public law, and special funds under public law, the registered office of the company identified in the legal notice shall be agreed as the place of jurisdiction, insofar as legally permissible.

For consumers, the statutory places of jurisdiction shall apply. No agreement shall be made that subjects consumers to a specific place of jurisdiction in violation of mandatory statutory provisions.

25. Final Provisions

Amendments and supplements to individual agreements must be made in text form unless a stricter form is required by law.

Should any provision of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The invalid or unenforceable provision shall be replaced by a legally permissible provision that most closely reflects the economic purpose of the original provision.

In addition to these General Terms and Conditions, the individual booking confirmation and the prices, payment terms, cancellation conditions, and other agreements specified therein shall govern the specific booking.

The designations “Legendary Escort,” “the Agency,” and “the model” are used in these General Terms and Conditions solely for linguistic convenience. The legally responsible company is identified in the website’s legal notice.

Overall, this English version preserves the structure and legal meaning of the German text, including the Agency’s intermediary role, booking and payment requirements, cancellation provisions, confidentiality duties, liability rules, and Dutch-law clause.
